The Service is provided "AS IS", without any express or implied warranty. Automated audits are based on the open-source axe-core tool and detect approximately 30–40% of accessibility violations (inherent technological limit). Human review by an expert remains necessary for full compliance. To the extent permitted by applicable law, Tajalys Inc. disclaims all liability for legal proceedings (notably ADA Lawsuits in the United States, AODA in Canada, EAA in Europe), loss of business, direct or indirect damages suffered by the Customer or its own clients as a result of using the generated reports. The Service is a decision-support tool, not a legal compliance guarantee.

7.1 AI-Generated Content: The Service uses artificial intelligence to generate code remediation suggestions. These suggestions are provided "AS IS" for informational purposes only. The Customer is solely responsible for testing, reviewing, and validating any AI-generated code before implementation in a production environment. Tajalys Inc. declines all liability for site downtime, data loss, or damages caused by the direct application of these automated suggestions.

7.2 Indemnification: The Customer agrees to indemnify, defend, and hold harmless Tajalys Inc. from any claims, lawsuits, or damages initiated by the Customer's own clients or third parties resulting from the use, resale, or distribution of the white-label PDF reports generated by the Service.

7.3 Liability cap: To the maximum extent permitted by applicable law, Tajalys Inc.'s total liability to the Customer, for all causes combined, is limited to the amount paid by the Customer for the Service during the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars (USD 100) if greater.
