1. Preamble
These Terms of Service ("Terms") govern access to and use of the AccessAudit platform (the "Service"), a SaaS web accessibility audit tool operated by Tajalys Inc. (the "Provider").
By creating an account or using the Service, you (the "Customer") fully accept these Terms without reservation. If you do not accept these terms, you must immediately stop using the Service.
By using the Service, the Customer also accepts Tajalys Inc.'s Data Processing Agreement (DPA).
2. Service description
AccessAudit is a SaaS solution allowing digital agencies to audit the accessibility of their clients' websites according to WCAG 2.1 and WCAG 2.2 Level AA standards. The Service includes:
- Automated audit report generation
- White-label PDF generation
- AI-powered improvement suggestions
- Multi-client dashboard
- Scheduled scans according to subscribed plan
3. Account creation
To use the Service, you must create an account by providing a valid email address and a secure password. You are solely responsible for the confidentiality of your credentials and any activity performed from your account.
You agree to provide accurate information and to keep it up to date. Any identity theft or fraudulent use will result in immediate account suspension.
4. Subscriptions and plans
The Service offers three pricing plans:
- Free: limited usage at no cost, no commitment
- Pro: monthly or yearly subscription
- Agency: monthly or yearly subscription with advanced features
Pricing and limits for each plan are detailed on the Pricing page. Tajalys Inc. reserves the right to modify these prices with 30 days' notice.
5. Payment and billing
Payments are processed by Stripe Inc., a PCI-DSS Level 1 certified provider. AccessAudit does not store any payment card data.
Subscriptions are automatically billed on the anniversary date of subscription. Plan changes (upgrade/downgrade) are applied pro-rata.
6. Cancellation and refund
You may cancel your subscription at any time from your account page. Cancellation takes effect at the end of the current paid period. No refunds are issued for the period already started.
In case of a major technical issue attributable to the Service rendering it unusable for more than 7 consecutive days, a pro-rata refund may be considered upon justified request.
7. Limitation of liability

The Service is provided "AS IS", without any express or implied warranty. Automated audits are based on the open-source axe-core tool and detect approximately 30–40% of accessibility violations (inherent technological limit). Human review by an expert remains necessary for full compliance. Tajalys Inc. disclaims all liability for legal proceedings (notably ADA Lawsuits in the United States, AODA in Canada, EAA in Europe), loss of business, direct or indirect damages suffered by the Customer or its own clients as a result of using the generated reports. The Service is a decision-support tool, not a legal compliance guarantee.
7.1 AI-Generated Content: The Service uses artificial intelligence to generate code remediation suggestions. These suggestions are provided "AS IS" for informational purposes only. The Customer is solely responsible for testing, reviewing, and validating any AI-generated code before implementation in a production environment. Tajalys Inc. declines all liability for site downtime, data loss, or damages caused by the direct application of these automated suggestions.
7.2 Indemnification: The Customer agrees to indemnify, defend, and hold harmless Tajalys Inc. from any claims, lawsuits, or damages initiated by the Customer's own clients or third parties resulting from the use, resale, or distribution of the white-label PDF reports generated by the Service.
8. Intellectual property
The source code, design, AccessAudit brand and all platform content are the exclusive property of Tajalys Inc. Any unauthorized reproduction is prohibited.
PDF reports generated through the Service belong to the Customer. The Customer retains full ownership of the data uploaded to the platform (logos, agency information, audited URLs).
9. Suspension and termination
Tajalys Inc. reserves the right to suspend or terminate without notice any account that:
- Attempts to hack, overload or bypass the Service's limits
- Resells access to the Service without written authorization
- Uses the Service for illegal purposes
- Uses the Service to scan, audit, or extract data from targeted URLs without the explicit legal authorization of the target platform's owner
- Fails to pay the subscription
10. Terms modifications
Tajalys Inc. may modify these Terms at any time. In case of substantial modification, active users will be notified by email at least 30 days before the new terms take effect. Continued use of the Service after this date will constitute acceptance of the new Terms.
11. Applicable law and jurisdiction
These Terms are governed by the laws of the Province of New Brunswick and the applicable federal laws of Canada.
Any dispute relating to the interpretation or performance of these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Moncton, New Brunswick, Canada.
